Terms of Use

Effective date: October 25, 2026

These terms apply to your use of Upscalo ("the app"), an app by an independent developer ("we", "us"). By using the app, you agree to these terms. They supplement Apple's Licensed Application End User License Agreement, which also applies.

1. Using Upscalo

We grant you a personal, non-transferable license to use the app on Apple devices you own or control, as allowed by the App Store terms. You may not copy, modify, reverse-engineer, or redistribute the app or its AI models, except where the law allows it.

2. Your photos and content

You own your content. Photos you enhance remain yours. We don't claim any rights to them, and they stay on your device.
Only use photos you have the right to use. You're responsible for having the necessary rights or permissions for the images you process, including photos of other people.
Use it responsibly. Don't use Upscalo to create content that is illegal, deceptive, harassing, or that infringes anyone's rights. That includes passing off altered images as authentic in a way that could mislead or harm others.

3. About AI results

Enhancements are produced by AI. Results may add, remove, or change details. Restored faces, in particular, are the AI's best estimate and may not exactly match how a person looked. Results aren't suitable for forensic, legal, medical, or identification purposes.

4. Free version and Upscalo Pro

The free version includes a limited number of free enhancements each day (currently 3), produces HD results (up to 2048 pixels on the long side) and shows ads. Upscalo Pro produces results up to 4K. When they're used up, you can watch an optional ad for an extra enhancement (a few times a day) or upgrade to Pro.
Upscalo Pro is available as a weekly or yearly auto-renewing subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy.
Free trials: if a plan includes a free trial, you won't be charged until the trial ends. If you cancel at least 24 hours before it ends, you won't be charged.
Renewal: subscriptions renew automatically at the same price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID.
Managing and cancelling: manage or cancel anytime in iOS Settings › your name › Subscriptions, or in Upscalo › Profile › Manage Subscription.
Refunds: purchases are processed by Apple. Refund requests are handled by Apple at reportaproblem.apple.com.
Restoring: use Profile › Restore Purchases to restore Pro on another device signed in with the same Apple ID.

We may change which features are free or included in Pro. Changes won't reduce what you've already paid for during your current subscription period or lifetime purchase.

5. Third-party services

The app uses services from third parties, including Apple (purchases), Google Firebase (analytics and crash reports), Google AdMob (ads in the free version), and a file host for AI model downloads. Their use is described in our Privacy Policy. Portions of the app use open-source software under its own license terms, included with the app.

6. Disclaimer

The app is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We don't guarantee that the app will be error-free or uninterrupted, or that results will meet your expectations. Keep your own copies of important photos.

7. Limitation of liability

To the extent permitted by law, we aren't liable for any indirect, incidental, or consequential damages, or for loss of data, arising from your use of the app. Our total liability is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

8. Changes and termination

We may update these terms. We'll change the effective date when we do, and continued use of the app means you accept the updated terms. We may stop offering the app or any feature at any time. You can stop using the app at any time by deleting it.

9. Governing law

These terms are governed by the laws of the developer's country of residence, unless the laws of your country of residence require otherwise.
